The whole process took over a year start to finish for me and this seems to be the same in most cases

I had to do the same thing, i actually think being declined is part of the process.

But if you've appealed, you will hear back from them eventually. I think it took around 3 months after i sent in my appeal before i heard back from them again.

My case was a bit different because I got accepted straight away but took me 12 weeks. Like I say there was no question on my case at the time I had just left a psychiatric hospital I do know 1 or 2 people who applied also and it took them about a year because they both had to reapply. I wouldnt be disheartened because my psychiatrist and physiologist remarked that 99% of their patients had to reapply and it was extremely rare to get accepted.

Yep from my time working with people who would be applying for this payment, in the last 3 years or so it seems it is just procedure to disallow on first application unless there is zero doubt/questions. You would be surprised at some of the applications that were disallowed actually. So I always warn people when they are thinking of applying to expect to have to fight for it. It's unfortunate for those who feel they are too sick to go through that hassle.

I first applied in Dec last year, got a refusal letter late Feb, appealed this decision and got a reply letter on Monday saying my disability allowance had been awarded and that my first payment will be in on first week of june, received my swipe/travel card earlier today. So took about 2months to get awarded DA after I appealed i think its standard that they reject everyone first time round, hope you hear back soon with a positive result!

    Hiya marguerite :)

When you sent in your further documentation did you send It to the appeals office in dublin or back to Longford?

  • Registered Users, Registered Users 2 Posts: 118 ✭✭marguerite2000

    Unfortunatly back to Longfprd

Marguerite you wouldn't have heard back any quicker from Dublin. Please God your review will be positive and you'll hear from them next week

If the additional documentation gave further context/support to your application then a review was the right choice. You can always appeal if the review is unsuccessful. But i would get your appeal in now and state that you are pending a review decision.

Do you know whether the medical examiner made the decision in your favour or not? It generally only takes a few weeks to get from the medical examiner to the deciding officer.

Unfortunatly i dont ,I got a local TD to ring on my behalf and as far as i know it was not mentioned although i was trying very hard to hear ;-)..
But at least i know now its progressing ,,i think it was just yesterday the medical examiner was done.
Would it be really out of order if i rang to ask did the favor it .

  • Registered Users, Registered Users 2 Posts: 118 ✭✭marguerite2000

Ok so i rang the TD again and she read to me what was said
,"the medical examiner has completed their examination of my documents and it has now been passed to the deciding officer "

Well when I had rang I asked if they had made the decision in my favour and they didnt mind telling me. Well I hope that it all works out and that they hurry up with their decision for you because I know what its like waiting and waiting for a decision :(

The waiting is awful ,might give a ring tomorrow, as if they didnt decide in my favour probably be refused again .

Under the Data Protection Act the SW staff couldn't give the TD any information pertaining to your claim
The TD is not exempt form the Data rules
If you ring yourself tomorrow they might tell you.
I have it from the horses mouth that TDs ringing up annoys them, and truthfully in these cases it achieves nothing though I can understand why people might think that it's a good idea

there was a longer version of this message on my email seems to have been edidited since ,
well when you are on the waiting end of this ,sometimes you just want an end to the endless wait, the dissapointment checking post every day ,when it impacts almost every waking thought, you will try whatever way is sugessted to you to find an answer,,thats what i did ,,,i never expected anyone to change their minds because of it ,nor was i trying to ,,just at this stage after seeing a few people i know getting their refusals and appeals sorted within 3 months ,similer circumstances to me and im waiting 8 months can be very upsetting .

I do sympathise with you. In fact I blame your TD who if she was honest should have pointed out to you that a call from her might actually prove counter productive
She should have directed you to the Citizens Information Crntre where you should go tomorrow and ask them if they can ring up to check the status of your claim, if you really don't want to ring yourself
The SW may still want to ask your permission to talk about your case to CIC , but they are generally happy to talk to CIC staff

i have found the citizen advice centre in my area very incorrect in their information many times to me,over the years ,they do not seem to be knowledgable in what they should be ,iv always ended up ringing a Dublin centre who have been much more accurate,,also in my area they are not helpfull,i have never had a productive outcome from them ,,but have for same querys elsewhere. But thank you for the in put ,,i guess i shall just continue the waiting game ...

On this positives you will in the next few weeks get quite a sizable cheque! also dont be confused when you go to the post office and it says a figure for thousands on the receipt but you only get your 188. Mine was the same said I was being paid 2500ish but had deductions of 2300ish.

I asked at the counter and she said that is the department paying back the local office for the money they paid while I was pending and my cheque would be sent out in the coming weeks which about 6 weeks later I believe it was.

You were basically on supplementary welfare allowance while your decision was pending which is pretty standard ,
If a person isn't getting SWA then they would get the backdated DA ,
But you were getting a weekly payment so you weren't entitled to a back dated lump sum

So i was a qualified adult om my husbands claim,,he recieved 124.80 for me which i know will be deducted.I was waiting 37 weeks from application,,letter says back dated to when i applied.
Will i get the difference back dated,i was awarded the 188.
,The lady in Longford just said i get any arrears minus any deductions ,,would hate to think im going get this lump sum and then not ,as the bills are awaiting ;-(

    Hi marguerite2000,

Can you advise what payment you husband was on while awaiting the outcome of your claim?

Was it Jobseekers Allowance / Disability Allowance - or was it a benefit payment i.e. Jobseekers Benefit/Illness Benefit, etc?

    Regards,

    Hi marguerite2000,

The payments you have described are what are called Allowance payments - they are subject to means tests.

The maximum rate of payment for a couple on a means tested payment is 188 for the main claimant and 124.80 for the qualified adult - in a case of a couple the 'family' rate of payment is 312.80 divided by 2 = 156.40 each

If your husband was getting JA at 188 for himself and 124.80 for you then your 'family' was getting the appropriate rate of payment, and as such you may not be entitled to any arrears.

I would not count on any additional payment at this stage...

    Regards,

    Regards,
HI,thanks for your reply but i was told by the Dissabilty Allowance section in Longford that it would be 188 to me if my husband is on JA, also my letter says i was awarded 188.
there is a link on the welfare website that states if the spouse of a person on DA is in reciept a social welfare payment they will each get the personal rate of 188..
i dont know how to link it.
when i applied my cwo told me to tick the box for seperate claims as othewise he would have become my QA.
I was always under the impression i was to get 188 and spouse 188.
My concern was whether id get the dfference backdated as i was a QA on his claim .
    Guess il have to wait

My friend is in the same position as you but vice versa (she is on JA and he is on DA) they both get a full payment so I'd expect you to get the difference of €60+ backdated myself!
