Traffic Warden jurisdiction

    HI, I received a Fixed-Charge Notice for no car tax recently but had the car parked on private property. The city council confirmed that the land the car was on was nothing to do with them but the appeal was denied. Can someone tell me if the warden had the jurisdiction in conjunction with the Guards to issue the ticket.

    The car was never on the road during the time in question. Had bought and taxed another car and had this one parked up waiting for a new owner to take it.

    You have to declare a car off the road in advance.

    OP, not all private property gives you immunity from the offence of failing to display a tax disc. For example, a shopping centre car park (assuming it's open to the public with vehicles) is a public place and you would be obliged to display valid insurance and tax discs. Whether the shopping centre tolerates or permits traffic wardens to issue tickets is another matter.

    You'll need to be more specific about what type of 'private' property the car was parked on.

    No, you don't. There's no such requirement in Ireland.

    I didn't know that you could appeal fixed charge notice.

    As per poster above - car can not be parked in public place. Some public places include private properties, like f.e. supermarket parkings.

    According to the road traffic act



    “public place” means any street, road or other place to which the public have access with vehicles whether as of right or by permission and whether subject to or free of charge;

    “public road” means a road the responsibility for the maintenance of which lies on a road authority;

    ....


    The corpo cover the public road, but a traffic warden can issue a ticket in either a public place or road.

    Yes, and motortax is required for every vehicle used (including parking) in public place.
