Advice needed in employment issue

    I would be grateful for advice if anyone can help. I applied for a job and met all the qualifications. I received a letter informing me that I had not been shortlisted as I had not got knowledge in a certain area. I produced proof that I had completed two exams in this subject but my appeal was subsequently rejected.
    I applied for another position (exact same type of job) in another county and was granted an interview. One of the persons on the interview panel turned out to have been involved in the decision not to grant me an interview in the first job. I subsequently was successful in my application and obtained the position, and he wrote excellent candidate on my marking sheet.

    I contacted the ombudsman and they said they don't deal with employment issues. Is there anywhere else that I can go to get them to investigate why I didn't get an interview for the first job. I believe I was treated unfairly and would like recognition that I was qualified for the position and should have been given an interview. I don't come under any category of the Employment Equality Act.

    I would just suck it up and start your new job and enjoy.

    Jesus only in Ireland. Recognition to prove you're qualified? You may have all the exams necessary, doesn't mean you can do the job.

    I'd let it go, you've nothing to gain and everything to lose from being an arsehole.

    So are you out to get the person who got the job in the first county turfed out of thei job because you should ahve got it?

    Do you want compensation for having your feelings hurt?

    Someone in management to get the sack because they were clearly biased against you for some reason?



    These may all be legitimate wants, but they are not going to make you popular in the industry. Long term, they could be very career limiting indeed.

    As an employer, at the rare times that we advertise jobs we get many applications, all must have the required qualifications. The majority of the cvs end up in the bin because they are poorly written or they don't have experience. That is not treating people unfairly, it is streaming the applicants down to a manageable number for Interview.

    Id say let it go and enjoy your new job.

    When I was hiring I had one part time position and one full time. I got hundreds if not over a thousand applicants for those two roles. I simply keyword searched cvs, scrapped the rest, read those, picked the 12 for interviews and moved on. Many of the other applicants were qualified, some were even better qualified, but that doesn't mean they got the job.

    Maybr yhe other person had experience as well as exams. Who knows. Let it go and move on. Was that your first time apply for a job?

    Thank you all for your replies, Yes I got the second job but I had to move over 100 miles away while the first job would be very local to me so it would have been preferable to have obtained this position. I suspect that this was used as an excuse. By the way, I am not trying to get someone else out of a job, as the position is now filled and the best of luck to them. I believe my application was not treated fairly and if it had I would have had an excellent chance of obtaining the position, so just a level playing field is all I wanted.

    Life is not fair as long as it's not for one of the equality reasons you can be treated unfairly. People are treated unfairly all the time because they got a degree from one university not another, because they went to a particular school etc. but that is not a problem it's life.

    What ever gave you the idea they had to give you an equal playing field? As long as they did not sort you out due to the big once (i.e. religion, sex etc.) they can decide not to hire you because they did not like the font you used and you could be the world's most qualified person and would still not have a leg to stand on in a complaint.

    How do you know that your cv was as good as the others who were called to interview? Don't kid yourself that life is fair and that the field is level, different employers use different criteria for deciding who to call to interview, there could have been many others with the same qualifications as you who also were not called for interview. I like your confidence in yourself but you do seem naive.

    You say want "a level playing field".

    Whether or not where was one at the time, or should have been one, are both good talking points (and I agree with what other posers have said about them).

    But right now, given that the local job is gone and you have another one, they're totally irrelevant. What do you want to happen now? Do you want compensation? Changes in the rules for future jobs? To have your day in court (and thus to get a certain reputation in the industry)? What, exactly.



    Oh, and there are some jobs where being "very local" is not actually a good idea. Being related to every yokel in the village just may be the reason why you didn't get the job.

    No one owes you a job. They can rule you out because they don't like the font on your cv, your turn of phase etc. It is their choice. I am sorry but you need to gtow up a bit. If you pursue this you are going to get a bad name on your industry and no one will hire you.

    It sounds to me from your original post its part of the same company??
    If so forget all this nonsense , put the head down and work hard.

    There's nothing to say they won't move you closer to your original post after a period of time . win win

    Thanks for all the replies, except for the ones who were a bit vocal and did not offer much in advice. The job I got is a lot better than I would have got in my home town, and I am very happy with it except it is over 100 miles away and costs me more money to stay away, when I could have been working local.

    I have the qualifications and experience and no doubt I would have done well in an interview if given the chance. I have applied for four similar positions all over the country and each time have obtained top of the panels in each case. It was a bit disappointing to not qualify for interview in my own locality, and then to be given a job with excellent candidate wrote on my marking sheet by the very person who did not qualify me for the job in my own town.

    However, life moves on and I am not bitter I see this as a great opportunity to progress my career further. Thank you all for the comments (except the keyboard warriors who offered little in advice)

    There is nothing you can do barr asking for the records of the previous shortlist.

    They have (from my reading of the situation) done nothing wrong.

    They were presented with a list of candidates and selected the most qualified,
    in regards to the first application your wording is concerning.

    If they wrote you a letter stating you were not qualified and you produced documentation proving you are your application should have been seen.

    If they wrote you a letter stating you were under qualified compared to the first 5 short-listed candidate then this seems more realistic.

    If they are for a BA Hons and all candidates have BA's they will higher it to Masters, if more than 10 have Masters they will higher it to 1 class or PHD level, thats the whole point of a short list, clear, concise rules as to who get shortlisted.

    The advice is the same from every poster, unless you were discriminated against on one of the recognised grounds, the employer has done absolutely nothing wrong, they found someone who they think is more qualified or better than you, that is their prerogative.
