Harrassment from Debt Collection Company Who Purchased Loan

    Hi,

    I am aware of a situation within rural Ireland of a very elderly individual living on their own who is scared senseless of threatening letters they are receiving from a debt collection company who purchased a debt from a bank who is no longer operating in the ROI.

    This debt collection company insist this individual owns the debt. I have it on good authority that this debt, 10k approx, was paid in full to the original lender some years ago.

    Their latest scaremongering tactic is to now have their legal team threaten this individual by insinuating they will be sending the sheriff in within 7 days. This individual doesn't even own a TV (this is the level we're talking).

    This is a pitiful scene and almost criminal behavior from these bullies.

    What should or can be done next?

    Having something on good authority isn't the same as having hard evidence. Have this person obtain proof of the payment and I don't see why it couldn't be resolved.

    Thanks everybody for your time in responding.

    No definitely not a scam.

    I haven't physically seen the receipt but a relative of mine (lives close by this individual) has.

    The individual in question is old school, debts paid on the button and receipts kept in a biscuit tin!!

    Its being explained to this debt company umpteen times that this loan was paid some years ago but for whatever reason it ended up in their bundle of debts that they purchased from a bank that once traded here. All rational has gone out the window and copies of receipts are being ignored:confused::rolleyes:.

    I agree that these letters require binning and so what if the sheriff calls but this individual is almost 80 and thinks different from our generation.

    Debt collection agencies will always harass continuously until a conclusion is reached

    If the debt has been paid to the bank on time then the bank will have the record of the payment and will most certainly furnish this to the debt collection company if a complaint is made

    If the bank has no record then bring the receipt to them and let them sort out the rest.

    If the payment was made the bank erred by sending the details to the debt collection agency and I would imagine a compensation claim for harassment could be made (not sure on this)

    When dealing with the bank insist that they ensure that the debt collection agency does not continue to pursue for late fees even though they know the capital has been paid

    would be worth a few quid for a solicitors letter? Along the lines of, "the debt was cleared, you have been told, either sod off or actually start proceedings, attached is copy of reciept"

    for the sake of peace for the person

    I agree totally about the stress this type of thing causes to older people. If there is a receipt for the payment then why not send the debt collection agency a copy of the receipt with an appropriate letter threatening Gardai Joe Duffy etc etc - whatever you consider appropriate. ( I am a bit confused by your post as to whether this has already been done in some way or other) Also if the bank have wrongly forwarded personal details in this case then surely there are also data protection issues - again be worth mentioning to the Debt Collectors.

    Also might be worth asking the Central Bank consumer section if they consider that the bank who sold the debit have a responsibility to help resolve the issue.

    This is a good idea as the original lender doesn't want to know (they were already contacted) and said they hold no information on this debt anymore and revert to the new owner of the debt which is this crowd of glorified thugs. It will be interesting to see what the CB have to say about their responsibility. I will keep the thread updated when they respond.

    Interestingly enough he received a nice as pie letter today from the debt collectors telling him they will look further into his complaint!

    You should also prosecute under Section 11 of the Non fatal offences Against the Person Act 1997.
