Sport and Cultural Employment Permit

Hi I was hoping someone could assist me with a query have around the granting of a Sport and Cultural Employment permit?

My girlfriend who is a Non Eu national who was recently declined due to the 50/50 rule. The issue I have is that citizens.ie states that a waiver will be considered for new start up businesses and where the employee is the only employee. My girlfriend qualifies on both of these issues. However the DJEI are only willing to grant a waiver if it is IDA sanctioned. I raised this with the IDA but such a waiver is not in the remit. Im lost as to why the Department of Jobs are unwilling to consider this waiver. My girlfriend is a dance teacher who offers dance classes to kids, adults and down syndrome kids. Her dance classes are completely unique and no other dance schools offers these type of classes.

Has anyone else been through this process? Any help would be greatly appreciated.
