Dealer driving traded in car through tolls

    Hi all,

    I traded in my car on the 12th April ..

    On the 13th April and the 18th April there are Toll charges on the car.

    Any idea what I can do about this ?

    I've removed the car from my eflow video account ( only did it today as I totally forgot about it.. only remembered to add new car when i got penalty notice for new car in post )

    same thing happened to me. Nothing we can do I suspect. It's our responsibility to make sure our e-flow account has accurate information in it.

    Even if i didn't have the video account... the car is still in my name until they sell it. so i'd just get the letters in the post.

    the logbook date of owner change and one call to eflow and the letters would go to the dealer.

    with the toll account I'm afraid nothing can be done since you didn't remove it. A lesson unfortunately , luckily only a ~6 euro lesson.

    I don't think your car is still in your name until they sell it? If that was the case you would have to tax it for the 6 months plus while it's in the forecourt - and being taken on test drives etc.

    Is it not the case when you sell it to a dealer ( trade in or otherwise) it's hteir property.

    the dealer said to just hand over the logbook ... as they didn't want an extra owner on it for when they sell it on.

    It's not a smaller dealership.. Don't want to name them yet !!

    The dealer is never counted an an owner when selling a 2nd hand car. I call b#llsh1t somewhere.

    the trade in in noted on my invoice.. and it has the reg / date etc.

    If you sell or trade-in your car, you are obliged to update the vehicle owner details on the National Vehicle and Driver File (NVDF). If the vehicle continues to remain in your name, you will be legally liable for any charges including, motor tax, toll charges and any penalties which may be incurred for any traffic violations (e.g. parking fines).
    SALE/TRADE-IN TO A MOTOR DEALER

    • You and the motor dealer must complete Form RF105 which is available from the dealer or is available for download at www.motortax.ie
    • You should present the Vehicle Registration Certificate ‘log book’ to the dealer.
    • If the dealer is enabled to notify the change of ownership over the internet (the larger dealers have this facility) no further action is required on your part. (The dealer will then retain form RF105).
    • If the dealer is not enabled to notify the change over the internet you must send form RF105 to:
      Driver and Vehicle Licensing Computer Services Division, Department of Transport Tourism and Sport (DVCSD), Shannon, Co. Clare.
    • Remember that responsibility to send the form rests entirely with you.
    • The DVCSD will record the dealer as the registered owner of the vehicle on the NV

    Go to https://www.motortax.ie/PSE and put in the reg, it should say traded in to a dealer on this date, if it doesn't the dealer is trying to sell your car off the books.

    Take a screenshot of that and email it to eFlow followed by a phone call maybe?

    I suspect you'll get the 'your responsibility to ensure...' email back.

    At least the dealer wasn't trying anything hooky.

    its only 5:20... i don't mind paying that .. once it's not still in my name.

    I should have removed my old car from my video account.. but totally forgot about it.

    Happened to me when I traded in a car to a dealer in Ballymount. I traded it in on a Friday afternoon. That evening someone went through the toll in my old car and back again on the Monday morning. I got a notice in the post and even though I rang the dealer who said he would pay, he never did and I ended up paying. Real dick thing to do.

    eFlow are decent enough so I'm sure they wouldn't charge for it if you showed them that ownership was transferred before it went through the toll.

    The issue here is not that the car is still registered in the OP's name but rather it wasn't removed by the OP's on his eflow video account when it was traded/sold on. Just ring Eflow, I'd be very surprised if they didn't just drop the charge.

    Happened me years ago when I traded in my car. Got 2 letters a few months later for fines for none payment of the tolls. A quick call to eflow to tell them that I sold my car before the dates of the fines and they sorted it out without any hassle.
