caught without road tax

    on my way to the nct center i was pulled over and stopped by the traffic squad, i was told my tyres were the wrong size for my car, that they were 16's instead of 16;s, after i told him i had 4 new 15's on the shades came off and he agreed, next i got done for no tax on the car, i showed him the details which were on the seat beside me, he said i will not give you the 3 pentaly points put you will get a fine of 60 euro, i am on the belif that one does not require a car to be taxed to present it for the nct, thanks in advance

    I think the law says failure to display a valid tax cert can incur a fine.

    Even if you had proof yuor car was taxed.

    I agree though, tax on a car has nothing to do with safety nor should it incur penalty points.

    I'm not sure what details were on the seat beside you - the car tax? If not, you were driving without tax and that's an offence and according to here the car can be impounded.

    So it seems the tax and nct were both expired when stopped.

    There are no penalty points for tax but there are penalty points for expired nct. If you showed him proof you have the nct booked he might have accepted this and that's why he referred to letting you off.

    Your only exempt for motor tax if the vehicle has been declared off the road and you are driving to and from the test centre, not declared off the road no exception.

    You don't need tax to be present for the NCT, but you do need tax to be present when you're driving on the road.

    You could have done you for both no NCT and no tax, but the fact that he's just going for the tax seems to be pretty sound.

    most guards would let you off, if it was only recently expired. I know this for a fact. maybe you just annoyed him. Ive never heard of a Guard taking any interest in your tyres unless they were manifestly bald and a danger, so Im suspicious you are not relating the full encounter

    New legislation out this week on tyres with points if not considered safe.
