Rubbernecking is bad enough, but recording it on their phones as they drove past? Idiots should have been hauled into court.

Rubbernecking should be an offence. These should be tendered here: http://www.theguardian.com/uk/2009/aug/02/car-accidents-prevention

After doing a few night time motorway journeys recently I don't know why they just don't build the centre barrier higher, would completely stop rubber necking and stop people being blinded by morons driving with full beams.

    Cost I guess...

When it comes to being blinded, Italians have brilliant yet cheap barriers. On top of regular energy absorbent barrier, they put plastic sticks. In the

They were not done for "recording RTA"
    They were done for
The drivers received three penalty points and were fined €160 – €80 for driving without reasonable care and €80 for using a phone while driving.

OPs title is misleading but too late to fix it now

Why misleading! From An Garda twitter:
2 drivers video collision on phones as passing scene, 3 points & €160 fine Fines €80 using phone & €80 for driving without reasonable care

I was held up for a good hour by the rubberneckers on sunday. At least this time it didnt turn out to be on the opposite side but they were still rubbernecking the piles of sawdust long after the accident was cleared. 2 points and 80 euro wasnt enough imo. I suppose its hard to write being a **** into legislation. How horrible would it be that the last thing you see before you die to be some absolute wanker pointing their iphone at you.

Your title "Penalty points for recording RTA" implies the recording itself is the offence, it's not - it's perfectly legal to record a RTA.
The offence is handling a phone in the car and driving without due care.
    You see the difference?

Ah ok, so title should have read "Two motorists served penalty points and fines for operating the video function of mobile phones while driving past a road traffic accident under the 'Holding a mobile phone while driving a mechanically
propelled vehicle' section of the Penalty Point System"

    This is in UK 2014

    http://www.mirror.co.uk/news/uk-news/rubber-necking-motorists-prosecuted-taking-mobile-4042382
Rubber-necking motorists to be prosecuted for taking mobile phone pictures of motorway crash

Four rubber-necker motorists are being prosecuted by police for taking mobile phone pictures of a motorway crash.

Other drivers were forced to hit their brakes as ghouls slowed down to take snaps as they drove past the wreckage of an overturned caravan.

They will be charged with either driving without due care and attention or without reasonable consideration for other road users
Glad Ireland is taking a good leaf out of UK's book.

i doubt that's the full story, either they were witnessed by the gardai holding their phones, or they had a really bad solicitor.

prove it was a phone and not a hand held camera...

It gets worse. I've seen morons stopping their cars and standing in the middle of the effing motorway to look at an accident on the other side of the road, with the Police being already on the scene and, of course, being none too happy about it.

I am not sure what's wrong with people nowadays, but they're getting stupider and stupider. Every time you see any kind of trouble, accidents and the likes, it's a w@nkfest of dimwits filming with their fcucking smartphones...and probably nobody actually thinking about calling an ambulance.

The offence is holding a phone, not recording an event.
They would have to have been stopped there and then, by the cop who observed the driver holding a phone.

I find it strange that gardai dealing with a traffic collision would have the time to be stopping motorists for other matters.

I find it strange that someone would question a Garda carrying out his/her duty.

If the cops are doing their job right they have to watch out for stupid drivers that are distracted, on phones, taking pictures or videos. Etc.

When working on a road or motorway and it still has live lanes they need to be watching as plenty have been killed or very badly injured by drivers that end up crashing into them or the previous collision.
