"Donating" penalty points

    I was caught driving too fast twice and just got my second fine and 3 penalty points in the space of less than 12 months. Both occasions I was driving in the city around 10kmh above the limit. These are my first ever offences after 25 years behind the wheel, so it's pretty annoying but I only have myself to blame.

    Anway last time I got one of these in the post I just paid up and returned the form. This time my hubby wants me to put him down as the driver as he has no points and thinks my 6 points will mean my insurance will shoot up. I don't even know if this is true.

    He reckons people do this all the time and it is no biggy. I would think that it's a crime and so a very bad idea. They include a photo of the licence plate in the letter but I assume they have a photo of the full car and driver. He was sitting beside me at the time and it was a bright sunny day. Hubby has a very clear goatee beard so we couldn't argue that it was really me if they do have a full photo of the car.

    Any advice? What is the worst that could happen if we did lie on the form?

    Advice? Don't do it, it's fraud. Worst that could happen? A few years in jail for fraud.

    Likely nothing will come off it though and nobody would be the wiser. But it's illegal.

    Worst that could happen.

    You are in a dehibilitating accident where you are injured and unable to work.

    You claim on your insurance.

    The Insurance company, fearful of a multi million Euro payout forensically goes through your file.

    The file shows that the car you were insured in received penalty points which were later transferred to your husband.

    They will requisition the pic from the private operator who runs the speed vans as part of the Discovery process.

    Your claim is thrown out for fraud.

    You will also have to pay costs of the action.

    Don't be an idiot.

    Secondly, your IP is probably traceable from posting on an online Forum asking solicitors to assist you in committing fraud. Something we are sworn not to do.

    Not asking for assistance committing fraud. I don't want to do it but need to convince hubby who thinks it is no big deal. Was hoping someone might have actual experience of a case where someone had done this.

    I don't think those cameras can make our who is driving. Didn't a load of people take a case in cork (mallow maybe) against the vans becuase they couldn't prove who was driving?

    Imo it comes down to morals. Is it reasonably commonplace? I dunno, I heard of a lot of young drivers transferring to their parents (or getting stung in their parents car and allowing them to take the points). For young people though it's not just a case of money, you're basically in not insurable with points.

    Correct. They send you the photo with the license plate, but they do have the full photo of the car. So, if anything was ever queried, they can show you were driving.

    Take the hit, and slow down. No point in making matters worse by comitting fraud.

    Check out the case of Chris Huhne and Vicky Price in the UK eacj jailed for 8 months for doing just this..... is it worth the risk?

    Would there be any data protection issues of a private company getting access to a person's data? Would they need to prove that the person that they where interested in was in the vehicle before looking for this?
