Invalidity Pension

    Wondering can anyone give me some information on what to expect when I appeal my review of refusal for Invalidity pension.I had all the letters for Consulatants and Drs stating my situation of not been able to work. What do I do next ? Thanks in advance

    Is it that you applied, were refused, asked for a review, and the review has been turned down so you've now decided to Appeal to D'Olier St?
    Have you any further evidence? Have you written a letter explaining in depth why you can't go to work
    You really need to spell it out
    For example, it's not enough to say " I've MS so I can't go to work " because some people with MS can work, because their symptoms are mild and some can't because theirs are severe
    If you are suffering from depression or another mental illness, you have to spell it out, ie, "Some mornings I'm fine but most mornings I can't physically lift my head of the pillow...."

    I applied and was refused then it was reviewed and refused ..it's my hand is the trouble can't use it for work had surgery and nerves were damaged..

    TBH your going to find it very difficult to get IP because could it be argued that with rehab and physio you could get your hand to a point where you could return to work? Did you apply for IP because your Illness Benefit was running out?
    IP is for people who have been unfit for work for 1 year and the doc says they will be unfit for at least another year
    I'd say you've been refused because it's difficult to definitely say that you wouldn't be fit for work in 12 months?
    What do you think yourself?

    I never had any benefits..done physio and no improvement..I know myself I am physically not able to work

    You mean you've been out sick from work for a long period and you didn't apply for Illness Benefit and then you just applied for Invalidity Pension?
    When did you last work OP?

    You wouldn't have been refused Illness Benefit because of your husbands wages because it's not means tested, it's based on your PRSI contributions.
    If you didn't work since May 2014 and you applied for Invalidity Pension in 2016 then you haven't enough PRSI for it
    If you applied in 2015 then that's a different matter

    Can you retrain? I worked with a woman who lost her arm in a car accident and she uses a head piece for the phone and can type faster than me with one hand.

    Does the Invalidity Pension operate if incapacitated from your particular work as distinct from any work whatsoever ?

    Medical criteria

    Invalidity Pension is a payment for insured people who are permanently incapable of work because of an illness or incapacity.
    To qualify you must:
    • Have been incapable of work for at least 12 months and be likely to be incapable of work for at least another 12 months (you will probably have been getting Illness Benefit or Disability Allowance during that time)
    Or
    • Be permanently incapable of work (in certain cases of very serious illness or disability, you can transfer directly from another social welfare payment or from your job to Invalidity Pension).

    I would think that you must be incapable of any work.

    You can't work on Invalidity Pension. If you wish to work on IP, you'd need to transfer to Partial Capacity Benefit. Disability Allowance allows a certain amount of work as long as it is of a rehabilitative nature, and if the income from it exceeds a certain amount, DA payment will be effected.

    What reasons were given for the refusals OP? From memory, PRSI contributions or credits are needed in order to get IP.

    Maybe DA would suit your situation better? There's nothing stopping you applying for both IP and DA at the same time. Have a look on DSP website for details.

    hi , I am in the situation where I was on illness benefit for 2 years following an accident & as per regulation ,it was stopped & I was advised to apply for invalidity pension.I was refused this & have sent in a request for review of that decision ( I had been informed by S.W. that this process can be done first & then can be appealed if denied) but I am just wondering if anyone knows how long the review process takes - it has now been nearly 2 months since review request was submitted. Thanks.

    Did you send more medical evidence with your request for a review?

    Yes , sent in very detailed report of specifics & letter from physio .
    Noted in previous post that a person was still waiting 10 months later for assessment review but as that was 2014 I am hoping that the timeframe may have improved.????

    If you ring them, they'll be able to tell you what reviews they are looking at now so you'll be able to gauge roughly when yours will be looked at.

    In the mean time, get an application in for Disability Allowance in case the IP gets refused. You may be entitled to DA instead. Are you claiming Supplementary Welfare Allowance when waiting?

    Have just seen this thread and am in similar situation. They received my request for review and further medical evidence at the beginning of March. Just wondering if you phoned up did they tell you what date cases they are looking at now? I have phoned several times and they always say they don't know.

    Yes , unfortunately ,I was given the same reply but was advised to ring back in a few weeks. In the meantime ,I know one lady was notified after just less than 3 months that her invalidity had been granted after review of initial refusal.

    Oh that sounds promising, hopefully it won't be too much longer for us - was that lady's sent in far ahead of march do you know?

    It's frustrating because in the DA dept they can tell you what date they are working on and that it's an average 12 week turnaround whereas IP say there is no average turnaround time, which makes no sense. I have asked my local TD to contact them but am conscious of not being a nuisance to them. Apparently they are very short staffed at the moment.

    I think that she requested a review in early Feb .

    Just to update, I received a letter today saying my invalidity pension has been approved. Payments will begin at the end of June and the arrears (from December) will follow. They received the request for review plus additional medical evidence on 2nd march.

    I just received a letter this morning from the apeals hearing saying i have been aproved. Does anyone know how long it takes for the payments to start coming in.
