Deceased name still property

    So I inherited a house a few years ago with the death of mother and I'm in the middle of selling it in a private sale.

    The names of both my parents were on the house, my father passed away in 2009 and my mother passed away in 2011.The mortgage was fully paid off in 1999.

    I figured I had all bases covered, (LPT, Water Charges, relevant death certs etc..) Contracts were sent to her solicitor last week. However the lady buying it says that her solicitor was on to her querying why my fathers name was never taken off the property and put in my mothers sole name after he died. Considering I'm the sole benefactor and both my parents are passed away now does it really make a difference now? Can something like this hold up the sale?

    I'd ask my solicitor but just so happens he's on annual leave so i'm just getting a little bit nervous

    Questions you need to conider:

    Did your father leave a will? Did it make provision with respect to his interest in the property? (This may be irrelevant as most such property will have been held as joint tenants if it was in both names. Your father's will, if any, is more of interest if it was in his sole ownership.)
    Do you have any siblings? Anyone else entitled to inherit?
    Did your mother leave a will?

    It's often the case that property matters are not tidied up on each death. It's more of a hassle to deal with it when you've already identified a seller.
