Backpay for social care workers - Nurse on Call

    Hi,

    My girlfriend is too afraid to ask as she believes she may not get any more shifts with the company, but she has been entitled for a pay increase for over the last year and hasn't taken it. She works as a care assistant and its unfathomable that it hasn't been taken into account on her payslip. She does need the money as she's currently in college, however from my previous experience, what I've heard is there are a lot of illegal record management practices and bully boy tactics being put forward towards agency staff.

    What I would like to know is,

    - What are her legal rights in terms of backpay?

    - Is there any recourse for data requests being mishandled?

    Of course she would like to, for the forseeable future keep working for the company as she needs to work, but it ticks me off that there are so many examples i've heard of payslips, employee records to name a few that have been mishandled (there practically prehistoric). It also appears to me that these companies are under the impression they can get away with mistreating workers with bully boy tactics, and threatening ("unproven") not calling for shifts. Hopefully you guys can help :)

    Is this to do with back pay for sleepovers? Private agencies unlikely to pay, ttm are though as far as I know.

    Apologies for the misleading title, its not social care, its health care assistant, but the same would apply as far as i believe. Just general shifts like, if its in a contract that an individual gets a pay increase from x date they should be entitled to recourse if it isnt paid as far as im concerned.

    If it's in the contract then she should absolutely be receiving it. Has she queried it with them? Are her colleagues in the position? Are they members of a union?

    She knows she's entitled to it, the difficult part of it is the positioning of it, as she has to "ask for a pay increase" despite it being in the terms. There have been other workers who have asked for it to be added and not been given a shift for months! I don't think they're part of a union though which is a shame, especially seeing as she's agency it wouldn't be seen in a good light.
