    The security guard is entitled to say anything that is true. From what I can gather the person concerned works in retail. If that's the case then there is normally a clause built in to the contract re theft etc. even if it's outwith the course of employment. It's unlikely that a large employer would fire someone without due process and a conviction but it's not beyond the realm of possibility especially if it was a smaller, less litigation shy, employer.

    Overall I'd say it's unlikely anything will come of it. However is it worth the risk of a potentially massive pain in the arse for one's entire life over stealing a Mars bar? I'm sure the person won't be stupid enough to do it again but Ireland is unique in Europe in not having spent convictions legislation. If they get a criminal record it's with them until the day they die. Any criminal conviction for theft will close the door on any retail job permanently along with a number of other careers; it might sound melodramatic, but it's the reality of it.

    Anyway I wouldn't be too worried about it I doubt much will come of it this time.

    Is a judge likely to convict someone for the theft of a bar of chocolate? Surely Probation Act?

    That said, not necessarily something one should risk.
