NCT fail

I brought a relative's car in for the NCT yesterday. Amongst other things, it's had a full front n' rear brake overhaul before Xmas with the local mechanic in preparation for the test.

It did however fail on a sticking rear brake, which I found odd since it certainly wasn't sticking when I drove it to the test center. Sure enough when I got back into the car after the test, the handbrake was pulled up so high it almost came out the back window and there was a slight rub on the back right drum even when it was fully released.

Over the course of the journey back and with normal braking, it rectified itself. The drum was cold and came off without a struggle and the shoes expand and retract properly. Car is driving fine. Seems to me that despite the handbrake being adjusted to work on about 4 clicks, the guy yanked it up to the last, caused the new shoes to stick slightly and all was needed was some driving and braking to loosen them up.

So have they any options here bar swallowing the retest fee?

The tester doesn't pull it as hard as he can to be evil, the aim is to test it works, always.
The handbrake should always release properly, even on more than 4 clicks.

I've turned this over a few times in my head and the conclusion I come to is, when the tester left the car out in the park, there was a problem which needed addressing and the only way it can be addressed is a re-test on the lane. Whether or not it he caused it or it was something minor that required no actual repair work to rectify, is irrelevant to the NCT, it will have to be re-tested.

Judging by past threads, people have gone through the NCT's customer service process with far more justifiable cases than this, and didn't get very far, so it would be pointless to follow suit.

The brake rebuild was 2 months ago, a lot of things can happen in that period. The tester was able to pull the lever a lot more than 4 clicks so either something has changed in the last 2 months or the handbrake can go a lot tighter than you or your relative have been used to pulling.
I don't see why you think the tester has done anything wrong here, the fact the brake stuck suggests an underlying problem that should not occur on a healthy system.
