Pursuing company who are using 2 aliases

    I have been pursuing a company for some time now through the Small Claims process. The company charged me for a new item, but actually provided an 11 year old item with no lifespan, which I only discovered later.

    The company is being deliberately evasive, giving me incorrect business owner names and business addresses, not answering my calls etc. The company name is not registered with the Companies Registration Office.

    Through my own research, I have now been able to identify another company, located in the same area of the city who are listed as providing the exact same service, with the exact same contact number. It is pretty clear to me that this company essentially created a website with a different company name but same contact phone number.

    This "main" company is registered with the Companies Registration Office, so I have all the owner and address details I need.

    My question is whether I can pursue this "main" company through the Small Claims process? Would the same contact number, same city location and the fact that they are providing the same service be enough proof that they are one in the same company?

    legal advice can't be given on this forum but the rules of court provide that where a person is trading under a name other than their own then judgement can be given against that person as if they had been sued in their own name. there is also provision for the court to substitute parties at any time.
    How it applies to your situation I can't say.
