Appeal for invalidity...confused

    Apologies for the long post. I applied for invalidity pension February 2015 after fracturing my neck. I was on illness benefits since the end of February 2014. When applying, I was not told it had to be the full year for same one condition. I was off for several years prior to this with a separate condition. I did not get social welfare during that time though so did not collect certs. From February 2014, I sent in certs continuously until my illness benefit stopped, but it was not a full 12 months prior to my invalidity pension application, I was 3 weeks off the full year. I thought, it was 48 contributions that was important and applied at that time. I am now at the appealing stage and was told at the appeal that because I did not send in 12 months medical certs, I had to be incapable for life, not at least a year. I was off prior to my neck with something else but if it's a different condition, it doesn't count I am told. My doctor doesn't think I will be back to work in the long term but the appeals officer said I would have to be incapable for life because of the whole 12 months certs. I am 37 so I think it would be difficult to sign someone off work for life. It has been a long wait for this to be told something I should have been aware of before applying. If this is turned down, can I reapply from scratch so I would satisfy this criteria? I'm not sure if I will be eligible for disability as my husband works, but not enough to survive on alone either. I cannot work as I'm in so much pain, need help toileting and I am on alot of medication. Any advise would be appreciated.

    That was the impression I got from the officer. She told me a good few times about disability and how that may be suitable also.

    You need to wait until the dept has written to you with the result of your claim,only then will you know.

    I think you've misunderstood what the officer said to and that your reading too much between the lines.
    This is why I don't recommend ringing the Department at all
    I'm afraid you'll have to wait till you hear by post and if you've any new evidence in the meantime you should send it to them.
