Time served abroad considered in sentencing?

    Ok...so I was a bad boy and did something illegal. Then I moved to another country. I've now been detained there for months in an immigration detention center as my passport got cancelled. I'm facing a 1-2 year sentence on return. My question is, will my time spent detained abroad be taken into consideration during sentencing? Especialy as the gardai left me here for so long.

    Cheers for any advice.

    P.S. I've been stabbed and had my jaw broken here, so don't worry....I'm being well punished here!

    Logic would suggest NO. Your time spent in detention abroad has zero to do with whatever sentence you face here

    Unlikely unless you've been held specifically awaiting extradition for the stated offence. Even then it doesn't automatically count, but the judge can take it into account.

    It sounds like you're saying you're being held because you've no passport, you weren't arrested on the foot of a extradition warrant or EAW.

    You need yourself a couple of solicitors/lawyers. One on that side and one on this side.

    TBH I thought they had it here, but I think the OP is in an immigration detention centre or was.

    Technically, no. But there are plenty of corrupt guards (3rd world country). We 'bought' the services of a local telecoms engineer, so we have our own private internet access...20mbs....better than commonly available to the public.

    Anyway, thanks to everyone for the replies. I knew Germany and the UK considered time served abroad but didn't know about our fair isle.

    It sounds like you fled the country to avoid prosecution and could not renew your passport because of this.

    Nope. Broke the law, then moved to asia years later. Tried to renew visa and got detained. Some kind of red flag on some system they checked...though they won't actually tell me the details. All i do know is that it was the gardai that requested my detention, and then seemed to forget that I existed for months. I just finally got clearence so that i can voluntarily deport.
