Faulty Engagement Ring - Company in Liquidation

    Hi,

    Looking for some advice on if there is anything I can do here.. Bought my engagement ring from a Dublin Jewellers that has been around for years at the end of November.. Middle of December 3 diamonds fell out, I was fuming but they handled it well got the diamonds replaced in two days and said if any other problems I could get a replacement or refund so all good..

    Yesterday another diamond falls out from different part of the ring - ring is still under 12 weeks old at this stage and well looked after (don't wear it every day etc) - resigned myself to getting a refund and getting a new ring even though I love mine and haven't seen anything similar to it but 4 diamonds out in 12 weeks screams faults/bad quality..

    Googled the number to call and tell them I would be refunding/find out opening hours to call in and bam - shop closed down at the end of January, company in liquidation... Am going to try go down the chargeback route, does anyone have any experience of if this is possible or if the bank will allow it? Or is there anything else I can try? Obviously can't return the ring as can't get in touch with anyone to find out where to send it etc. Disaster situation :/

    Chargeback won't work as you have the goods.

    Unfortunately your options are limited as the company no longer really exists and even if you were to go to court looking for a remedy you would be at the bottom of the pecking order to get paid.

    Find an other jeweller who can repair to a decent standard and appreciate the fact that you will still have the ring you wanted

    You may very well be correct.

    If it is an involuntary winding-up, there are going to be more debts than assets.

    However, if it is a voluntary winding up of the company, the company is supposed to be solvent.

    Depending on the value of the ring (more/less than than €2k), it may be worth bringing proceedings against the company in the Small Claims Court, getting judgment, landing judgment in the liquidator's lap and seeing how many cents can be got in the euro.

    Probably worth a chat with a solicitor wrt identifying the correct name of the company by means of CRO searches and making the claim, etc.

    If action is going to be taken, it would be worth moving quickly, before other judgments and creditors emerge.

    Bank are going to try to do a chargeback as I have offered to return the ring and have tried to get in touch.

    Went to another Jewelers and they said it would need to be completely reset and diamonds they replaced don't match the original ones in the ring... Will cost a few hundred to have all diamonds replaced, reset etc. €3,000 later it certainly doesn't feel like I should be grateful to have a faulty ring with missing diamonds and ones that don't match... Thanks for the replies, just trying to look into how to get the details of the closure now (solvent etc).

    If you have no joy getting your money back, bring it in to Fast Fix in the Square in Tallaght.

    I was in with them yesterday to get her ring re-sized and they were so expert and detailed in assessing what they could do. We were told that it could not be resized by a number of jewellers but the detailed examination that this guy did meant that he found a way! Maybe they could do something in regards to securing your diamonds.

    There are many more reasons other than non-supply under which a chargeback would be appropriate. E.g. The goods were delivered to you but were faulty or not as described.

    Best of luck, hope you get your refund. Maybe take a good few pictures of the ring, or even bring it in to one of the diamond specialist jewelers who make rings and they might be able to make a copy of it for you?

    Thanks for the suggestion will definitely look them up... Have taken lots of pictures so hoping I could get another made if I needed to, I know I have only had it for 12 weeks but I'm already attached to it :)

    That's totally understandable, it would be a nice resolution if you could get it freshly made and know the quality is good.
