    Caught a community radio station using one of my pictures to advertise for one of their slots and looking for BAI info on copyright infringement. I've asked for payment and was asked in return for a vat number, was I registered photographer etc. they could only pay with vat invoice or they may be able to donate some of the amount. They are talking with the board on Monday and not to send an invoice till then. I know I don't need any of these and doing up invoice anyways but want to get as much ammo as I cant to send them.

    Obfuscation.... you don't need a VAT number to write an invoice. Just tell them you don't charge VAT! What's a registered photographer? No such thing unless you count the various "Professional" bodies who will take you on as a member once you're willing to pay the annual subscription.

    Tell the cheeky chances that your annual turnover is under the threshold to register for VAT ... think of a nice figure to invoice and double it. .. cheek of them... they stole your property.

    I doubt you'll find anything in BAI rules. It's simply a case of breach of copyright. Just send them an invoice for an amount of your choice.

    Done. I'll call BAI on Monday and see if the have any pdf's on radio licensing and copyright.

    Going after a community station for a few pound is awfully mean, the whole "think of a nice figure to invoice and double it" attitude is questionable. How much do you think it's worth? A community station is run by volunteers who give their time freely, looking for money for a minor once off copyright infringement wouldn't be worth most peoples time or reputation.Good luck in getting "as much ammo as I cant to send them.":rolleyes:

    Why is it questionable? They would have paid for stock photos so why not pay for my pictures. What's the difference between a company using your photos and radio run by volunteers using your photos without permission? there is none, copyright infringement is copyright infringement no matter who you are and I'm fed up with the excuses. After the call today yes I want to get as much ammo as possible for every possible excuse that may be used to get out of it.

    How would you like it if you hired a photographer to do a advertising shoot for your business and then a rival comes along and takes all those photographs and uses them for their own business free of charge. I'm sure you would sit back and say that was ok. :rolleyes:

    It doesn't matter what it is or even how good it is. A picture of a potato sold for $1,000,000 recently. What matters is someone used it without permission.

    If they had asked if they could use the image for their community radio station then many would allow it for free, or a minimal charge. It's the fact that they just took it that has caused the upset.

    This isn't about how good a picture is etc this is about taking someones work and using it without permission. I won't post the picture.

    They asked in the past if they could use a picture and I said it was fine. It's the fact they didn't ask is the issue.

    Have screenshots for each date it was used. This is not the first time my pictures have been taken and used without permission which is why I so fed up with the it's on the internet so I can use it attitude.

    They could have asked for permission to use the photograph in the first place. They owe the OP for using his work without his consent.

    Had to chase them up again on email I sent 9/02/2016 and got a response that they would pay up. Paying by cheque and I have asked for it to be registered post.

    No business is obliged to register for VAT unless their gross earnings exceeds a certain figure within a tax year. I think its around 30 - 35k but don't quote me on that figure as it could have changed. Ive no doubt theres plenty of fully registered legit photographers who just work part time and don't exceed those earnings, so wouldn't be registered for VAT, and they're fully correct not to be.

    They're either misinformed or are deliberately trying to put you off. If anything you don't even need to be a registered business to issue them an invoice. As an individual you are allowed to earn a small amount from your hobbies before its liable for tax. I vaguely recall it being about 3k in one tax year but I'd double check the exact value with Revenue as its a few years since I looked into this stuff in detail.

    I wont post the image but they put their logo on it which is altering it without permission and the image by name and description pretty much matched the name of the show. :D

    Just had a another one taken this time screenshot of flickr with watermark and copyright info cropped out and posted on instagram and twitter. i disabled sharing and downloading on flickr to stop this happening. Whats makes it worse is admin of the local photography page was the one who swiped it. Wanted me to delete any reference on twitter and facebook after his pm apology to what he did cause his account was associated with his job account. After his remarks and behavour I decided to leave the one on twitter and one on my own page. I got the abuse for posting on his page why I deleted all flickr links and the reason why i wont be posting on the page again. Getting a reputation it in the area for chasing people. Not my problem if they get caught :)
