Unpaid Overtime/Minimum Wage

    I have a part time job working about 20 hrs per week at the minimum wage, Recently due to shift changes I have to work about 30 minutes extra per day which my employer says is unpaid. Just for the moment forget about the unfairness of this.
    My question is this: i receive €9.15 per hour x 20 = €183 per week
    but I work 22 hours per week so €183/22= €8.32, so would I be correct in saying to him that they are paying me below the minimum wage which is illegal?

    Hi I'm not sure, but you should get casual payment money from Social Protection if you're not getting it already.

    Overtime is work done outside normal working hours.There is no statutory obligation on employers to pay employees for work completed in overtime. Many employers pay employees higher rates of pay for overtime"

    From citizens information, they don't have to pay you for overtime but unless an expectation is given within in your contract you don't have to do it either.

    One thing I would do is take note of any overtime you do anyway.

    So do you get a pay slip with hours worked? Do you have breaks that are unpaid for? Are your hours changed every week?

    Minimum wage is just that. The problem is are you working over time without pay?

    I hate that it's expected in many jobs now. If you work for free you will always have a job.

    Fight for your rights. Confront your manager with the facts in a professional manner. Detail your hours, breaks and bring contract. Wage slip & what ever else you can think of to prove you are working more then getting paid.

    Ask for an explanation.

    Have question ready as sometimes your mind can go blank.

    I would certainly say that you should be paid for the extra hours worked as you are currently being paid less than minimum wage. What would be the point in having a minimum hourly rate if employers could tack on extra "overtime" hours to bring hourly pay to below that rate?

    In general though I don't think there's a legal obligation on employers to pay for overtime. I worked for a company who specified in the contract that employees may have to work up to 48 hours on occasion "to meet business needs".
