farmer planting trees

    Hi, a farmer has started planting trees across a narrow road from my mums house, which will block light and lovely view in time, there was no notice given, or no one was in touch with her about this,
    I have tried to speak with him, but got door slammed in face when asked about trees,
    is there anything that can be done, or did he not need planning permission, or permission so some sort? is there anywhere I can find out more about this?
    not that I have anything trees, but in time it will make mums house so dark.

    You don't own the view and the farmer's perfectly entitled to plant trees on his land.

    He'll be liable if the trees cause damage, but apart from that, you're winding yourself up over something you can't do anything about.

    Ok, thank you, I just thought when they grow , they will block out the natural light, I was sure everyone was entitled to that at least

    I didn't think there is such a thing as a right to light.

    The tree council suggest there might be.

    Heard of a knapsack sprayer of roundup being used in a similar situation.:( How many acres are they planting? I'm not an expert, but if it's over a certain size they needed planning permission and or env. impact assessment. Now I could be wrong on this, legislation changes all the time.

    If the seat's wet, sit on yer hat, a cool head is better than a wet ar5e.

    Spoke with forestry, handy for anyone else to know, so trees have to be 60 m away from house, unless written permission is given, if permission given, trees can be planted 30 m,

    OP, You didnt mention that it was a grant aided plantation. :D in which case the above is correct: the Forestry Schemes Manual page 27
    Dwelling Houses/associated buildings setback areas
    The setback distance from dwelling houses and associated buildings is 60m, or 30m where written consent of the owner is granted prior to approval, must be observed. Set back distance is most critical when a building is surrounded by forest on two sides or more. Where adjoining properties are 0.2 hectares or less, planting should be kept back 30m from the property boundary.

    The Treecouncil appear to be referring to UK Common law, upon which Irish law is based, ie the Prescription Act of 1832, right to ancient light (prove enjoyed 20 years of light or more). afik there have been no right to light cases in Ireland involving trees.

    To take a case, you would probably have to wait until the light was removed to take the case and even then the "amount of light" would come into play.
