Pay for St Stephens day

    I work for a company which operated 24/7. There are staff which work shift rosters which mean they work any day of the week, and then other staff who work Monday to Friday.

    For those who work Monday to Friday, they got Monday the 28th off as St Stephens day fell on the Saturday. But I'm wondering what way the pay should work for those who work St Stephens day, will they receive double pay, or will the staff who worked the Monday get double pay. I have been looking on the internet but am see both sides of the argument.

    When I worked shift in that scenario you got double pay for the Monday which is a public holiday. But nothing extra for the 26th. However we got an extra eight hours pay for the Monday even though we were off. We would never work both days. Other companies may have worked it differently. In practice we rarely worked the 26th and anyone who did it was voluntary and they got overtime.

    Also bear in mind shift allowance covered the unsocial hours.

    The public holiday was still on the 26th, not the following Monday.

    Public holidays falling on a weekend

    Where a public holiday falls on a weekend, you do not have any automatic legal entitlement to have the next working day off work. This will occur in 2015 when St Stephen's Day (26 December) will fall on a Saturday. This means that Monday 28 December 2015 is not a public holiday. Your employer can require you to attend work on those days. When this happens you are entitled to one of the following:
    • A paid day off within a month of the public holiday
    • An additional day of annual leave
    • An additional day's pay
