Land transferring

    Hey everyone!
    My father was left land years ago and when he got it he never registered it into his name and then he sold it to our neighbour without solicitors involved or no paperwork either , our neighbour had it for years and then gave it to his son. When his son got it he went and got it transferred from the man left it to the father into his name, just wondering what would it involve doing when there was never any papwork done !

    Technically, the family of the person who died still own it and can claim title to it.

    Time to call a solicitor to sort out a big mess, it won't be cheap.

    it's our neighbours now because his father bought it but I can't understand how they got it registered when no paperwork was done when they bought it !

    Have they had it long enough to claim "adverse possession"

    Yes they would of but they didn't get it transferred on adverse possession because I checked the title on there folio and its freehold, possessory fiat would be there if they claimed adverse possession

    Well there is either a lot you don't know about or a lot you are not telling us.. land registry entries don't happen unless there is paperwork :)

    Id say your right and I wouldn't ask the neighbour how he got it done because he wouldn't tell ya , what would they of needed to get it registered ?

    It would depend on the title - either land registry or registry of deeds.
    It can be done DIY if you know what you're doing but most people would need a solicitor to do it correctly.

    There is a lot of money being made today by proper experienced conveyancing solicitors sorting out the messes left behind by the 'quick sale' cowboys of the boom era.

    Long time ago title to small holdings in some areas were transferred by vendor pulling a scraw off the roof and handing it over to the purchaser.

    Heard of this being done even in cases where a more formal transfer was executed

    Basic process is go to LRO with transfer of title documents signed by both parties and proof of stamp duty / other mandatory taxes LPT/Water/Refuse etc paid.. I don't think the straw method works any more. :)
