planning application on a site with an existing planning permission

    Hi all,

    I am looking at buying a site for our family home that has an existing planning permission for a 2,200 sq ft house which is a one storey over basement dwelling. The planning permission was granted 2 years ago for the new build house on the site (so it has 3 years left before it expires).

    We would like to add an extra floor to the house in order to have a bedroom and bathroom upstairs. So the new build would then become a 2,700 sq ft house which would be a two storey over basement dwelling. We will need to file a fresh planning application for this.

    My question is this: If our planning application for the 2,700 sq ft house is turned down is there any circumstance that we could also loose the existing planning permission for the 2,200 sq ft house ? Or are we guaranteed to still have this permission no matter what happens with our application ?

    Very quick answer....yes. Any new application will not void/nullify the original planning permission, so, you would be able to at least fall back to that.

    one further question: could you start building the 2,200 sq ft house under the original planning permission, and then add the extra floor if the application for the 2,700 sq ft house was successful ? or would you have to wait until the second planning application decision before commencing building ?

    In theory, yes, you could start building, as long as your application would be for amendments to the previously approved plan (and not an application for a new/different house!).

    Practically, you would be far better off to wait and see how your application gets on before starting any building, as, increasing your house area x 500 sq.ft. would have implications for building regulation compliance.

    The potential issues with building regulation compliance are a bit mind boggling...not something I can allow myself think about on a Friday evening! :)

    You be best talking to/engaging a professional about your plan to determine the best way to go.

    You would have to lodge 2 commencement notices in that regard too. Will,need two sets of,construction drawings also.
