Statute of Limitations

    Hi all,

    I believe the statute of limitations for making a medical claim is 5 years. Does anyone know if this applies to the whole year or from the date you make the claim?

    I.e. if I was to make a claim in March next I can claim for:
    a) 2012, 2013, 2014, 2015, 2016 (5 years)

    or

    b) March 2011 to March 2016 (5 years)

    Thanks nompere! That clears up a lot.

    By the way, do you know if Revenue can only go back 4 years as well?? I.e. they won't be catching you for something you might have forgotton to declare back in 2010 when you put through your claim. Strictly hypothetical question of course ;)

    Afaik revenue can go back as far as they want to. The tax payer can only go back 4 years

    Revenue threaten that they can go back as far as they like, but with data protection, bank's won't supply transaction history greater than 5 years old....so in reality, the evidence dies

    Firstly, under tax law the taxpayer has an obligation to retain their records for 6 years.

    Secondly, if Revenue have reason to believe a return fraudulently or negligently understated liability they can and will raise a tax assessment and it will be up to the taxpayer on appeal to disprove the assessment.
