I was looking at a i40 through a private sale, is the warranty transferable by a private sale or must you buy from a dealer to avail of it? Are there any restrictions to buying privately?

Nope, it transfers. As long as the service schedule is kept.

Transfers with the car as colm_mcm says. On new models they're selling now, there's a free annual health check also. I think Hyundai dealer advised me that you have to get that check done for warranty also. He advised I could get it serviced anywhere I like as long as I use genuine Hyundai parts. I don't think that's realistic (messy having to prove what was used) so better to stick with Hyundai dealer for servicing & get check done at same time while warranty valid.
