    Hi everyone
    (hope this in the right thread)

    Has anyone ever tried to get money using the eu261 directive
    I sent in a complaint and instead of addressing the issues i mentioned they simply said that if you accept a refund which is like 30 euro you waive your right to compensation,

    that doesnt sound very fair, i lost out on a hotel and they didnt meet there conditions of looking after passengers,

    is it a loosing battle going after them?

    I recently got compensated under it but used a solicitor that specialises in flight delays. I feel if I tried to get it alone they would have fobbed me off

    Stick to your guns and they can't really fob you off forever once the law is on your side.

    they sent me the refund after i sent the complaint and said on a email a few days later once the refund is accepted (i asked them take it back) you cant get compensated

    a well known irish airline, and flight cancelled due to weather( which i also dispute).
    now i dont believe they actually gave a reason for cancelling

    i have filed in the small claims court but might .
    i think its time to fight back we always seem to be the scraping on the shoes of companies

    I tried to claim some years ago but got nowhere.. Deicing system had failed on incoming flight and it had to turn back. I was put on next scheduled flight four hours later but missed connecting flight on different ticket on dec21 a few years ago. Had to fork out a small fortune to get home:(. They said it came under 'extraordinary circumstances ' clause.

    Sad but it happens. Im sure you were aware of the risks of the cheaper option.

    Indeed. But for that particular journey (3 flights) it was the last time i attempted it on two different tickets

    I've been compensated three times under this rule. British Airways and KLM paid up promptly with no fuss, but Vueling tried to fob me off repeatedly. Some online research suggested I wasn't going to get anywhere with them, so used Flightright.com and was compensated after 3 months. They take 25%+vat but otherwise I feel I would have got nothing. In the end, even the reduced compensation was twice the value of the flights so I was a very happy camper.

    thanks for the replies.
    i filed in the small claims court,
    the holiday insurance came up with this great line that the storm was brewing before the cover date of the policy so ill be appealing against them too,
    i hope we start getting the service we deserve instead of being fobbed off.
    I will keep this tread updated as i go along.

    Years ago I got reimbursed for a flight cancellation due to adverse weather conditions. The airline in question refused to provide accommodation, meals, refreshments or assistance. So when I got home, I wrote a letter to the airline spelling out each specific part of Directive 261 that they had failed to comply with and they coughed up pretty quick.
    Pat and his wife, Maureen, planned to fly from Dublin to London to celebrate their wedding anniversary. They had booked a luxury hotel for the two nights they planned to spend in London. On the eve of their departure, the flight was cancelled. The hotel charged them full price for the first night as the notice was too short to obtain a refund. The airline has refused to honour the cost of the hotel despite the fact that Pat and Maureen returned home to their house in Dublin while awaiting news whether the flight would take off or not and did not cost the airline the overnight accommodation to which they would have been entitled. They tried to claim the cost from their insurance but soon discovered that this was not covered. They now propose to take the airline to court to reclaim the cost of the hotel accommodation which amounted to 500 euros.

    This is an action which Pat and Maureen can bring themselves, without the intervention of a solicitor before the Small Claims Court in Ireland as the value of the claim is less than 2,000 euros.     However, before commencing this procedure, Pat and Maureen should consider their chances of success.
