Disregarding Separate Legal Personality - Business Premises

    Hi,

    Just a quick question...

Can the courts disregard a subsidiary's separate legal personality based solely on the fact that the parent company owns the subsidiary's business premises?

If so, can you please advise on the relevant case law.

    Many thanks,
    Hugo

No. One aspect of one module that I am being examined on this semester.

I cannot find any reference to this in my notes / books.

To anyone willing to give a helping hand,

I am essentially wondering whether you can pierce the corporate veil solely because the parent co. owns the subsidiary's business premises?

    Thanks,
    Hugo

Look up "Corporate Veil" in any good Company Law textbook

2013 Bar Review has an article; 'Laying Siege to the Corporate Veil'.
    https://www.lawlibrary.ie/rss/barreview/5-2013.pdf

    Haven't read it.
