Wall fell on Jeep

    i have my jeep parked on in the car park of my local last night.
    They have a flat fee for parking there.
    Cam down to collect it today and a wall (its a boundary wall) i had parked beside fell in on top of my jeep. Its effectively written off.

    My question is, who's insurance company will pay?

    Pub car park will be covered under public liability.

    You have 3 options.
    Claim off your own
    Claim off pub
    Get a solicitor to fight your case if none of above work.

    2 issues,
    I had 2 claims on the farm last year and my insurance company didn't want to insure me this year, so would like to avoid that!

    I forgot to mention that the boundary wall is between the pub and a solicitor!!!

    the pubs is 100 % responsible for your vehicle damage . especially since they are charging you to park there

    it is up to them to sort out with next door as to who is responsibe for the wall. usually it is 50-50 but who owns the wall

    What caused the wall to fall down?
    If it were due to flooding, the "act of God" clause may be used by insurance to avoid paying out.
    I would approach the pub owner first. I assume you took some photos or left the jeep in situ to substantiate your claim.

    If the wall was previously in good condition, structurally, and storm winds brought it down, then the owner(s) of the wall are not liable and you must rely on your own insurance for redress. If the wall was defective, you have a case, especially when you pay a fee

    A structurally sound wall can't be brought down by storm winds.

    Firstly, you better give the car park a thorough search for any "Cars are parked at the owners own risk" type of signs.
    If you don't find any, go into the pub and ask them to point out where it is, or admit there isn't one.

    Otherwise one might magically appear in the next day or so.

    While those signs may or may not have a strong legal standing, you may have implicitly agreed to this by parking there.

    I'm not a solicitor, just know that a lot of businesses put those signs up, perhaps as part of their insurance policy conditions.

    Those signs are more to cover break in and theft as they don't propose to provide security for your car.

    Going down to the insurance company this morning, so I guess I'll know either way today.
