    Hi, 3 years ago my business went bust. It was a partnership. We owed the revenue money but have not been in a position to pay back. I've since split up with the partner and I owe my half, I'm looking to set up a business again as a sole trader, will I get a tax Clearence cert to allow me to do this?

    On a separate note, it's not correct to say you're liable for your half of the partnership debts - partners are jointly and severally liable for all debts. So you are both on the hook for all debts.

    It was a business and personal relationship which has seen us split up, if I try and sort my side will they seek me to cover her side too? Suppose if she wrote a letter saying half was her liability?

    Do the revenue go after your pps number and not the cro number? How do we try and start up a business again?

    Revenue identity you by your pps number, but your individual number will be linked to the partnership number so they'll be aware of your history.

    If you set up a business as a sole trader, you might have difficulty getting registered for VAT and may have to pay a bond.

    The best option is to try and set up an installment arrangement and pay off your share of the partnership's taxes. Get your ex partner to do the same. But I doubt you'll get a TCC until the old taxes are paid off.

    Hi OP, you won't get a tax clearance cert unless you have a payment plan agreed with Revenue in relation to the partnership debts. As others had said you wouldn't be just liability to your half but to the whole lot if you ex business partner cannot pay. Unfortunately I have seen partnerships break up and one person left to clear up the liabilities.

    Sorry for hijacking the thread but can a non assessable spouse get a tax clearance cert in their own right?
    They have a trade but the pps no is not registered for tax themselves
