Right of way

    I couldn't find a thread that this really fitted into but mods please feel free to move it somewhere else.

    My oter half and I looked at a house. We both loved the house- a period terrace red bricked house. It's the end of terrace house and had a little lane down the side for rear access but the catch is all four houses have a right of way through the back garden gate through the garden in through each garden to access their own garden. It's in the deeds of the house.

    We don't like it but love the house. Has anyone bought a house with such a thing? Any issues / warnings ?

    Never been in that situation, but my grandfolks had a house where there was a shared access lane at rear, and the neighbours had a key to it only - maybe something similar is in place?

    Any way you can screen the walkway e.g. push it to the back of the garden?

    Unfortunately the pathway for the right of way passes right behind the back of the house- right by the kitchen window. It also seems they never lock the gate as everyone has to be able to pass through at any given time.

    I reckon you would need all four others to sign away their right to the easement or create another right of way that replaces the existing. Again consent from all required. Very unlikely to get four owners onside If you can't live with it, it might not be the house for you. Would definitely bother me.

    Well, you'd probably get the 2 of the others on Board .. because they probably have the same issue as the first house .. I assume the 4th house doesnt have a right of way passing its kitchen ...
    If it was possible to replace the right of way next to the house with one at the back of the garden to everyones satisfaction.. then game on .. might mean you giving up some garden and a heap of engineers and solicitors fees for you to pick up though..
