    Hi I'm just wondering if someone has a criminal conviction for section three assault and got a three year suspended sentenced can they travel to america for a holiday

    Not under the visa waiver programme. They would have to apply to the embassy for a holiday visa and be called to the embassy for interview to decide if it would be granted.

    Nobody can answer that question. It's a case by case basis

    On the same note, can anyone tell me whether there would be an issue travelling to America on holiday if you had a garda caution?

    +1 However, given the tightening of immigration at the moment, I wouldn't be extremely positive of success (depending of course on the severity of the crime).

    Look at the questions that are asked;

    Have you ever been arrested or convicted for a crime that resulted in serious damage to property, or serious harm to another person or government authority?

    Have you ever violated any law related to possessing, using, or distributing illegal drugs?


    Answering Yes to these questions will result in a refusal and you will have to get a tourist visa.
