    Hi All
Looking for advice on how to proceed.
My daughter was a front seat passenger in a car that was involved in a three car accident yesterday, she was in the second car that struck the car in front that had braked suddenly and the following car then failed to stop in time.Thankfully she wasnt badly hurt, pulled muscle in left leg, pain in back and headache. I got her in to see her doctor who perscribed anti inflamatories and pain killers as she would, he reckoned, need them as she would prob feel worse the following day, he was right:(. She is a uni. student who works at the weekends, couldnt work as in pain. Any suggestions as to what she should do, Her driver will be claiming against the driver that struck him, she doesnt want to get tangled in any wranglings with the insurance company as she is thankfull to have walked out of things in one piece but the driver and another girl who was in the car are advising her to seek some recompense. If she does decide to do this should I advise her to go to a solicitor or is there some other way to handle things without getting a solicitor involved. We are a bit clueless in this situation.
    Thanks in advance.

If the driver of the car your daughter was travelling in, failed to stop and hit the car in front, your daughter will have to sue that driver. If the 3rd car in the chain then hit her car, they have a liability too.

It's a solicitor job I'm afraid and you need to be aware the driver of the car she was travelling in is facing a share of the claim

If she is hurt go to a doctor, if she is not do nothing. She will put in a claim on the insurance of the car she was travelling in as he was at fault, when you crash in to the back of a car you are at fault.

The driver she was with caused the 1st accident, the 3rd car then failed to stop and hit the middle vehicle. The injury claim for the daughter will be apportioned between the drivers of cars 2 & 3

How do we know where she sustained the injury? If it was the initial crash then all claims would be through the car she was in.

That is precisely why it will be apportioned. The passenger suffered 2 impacts on account of negligent acts by 2 drivers

    Thanks all
She prob wont bother with claiming so because she will reckon that claiming off her driver wouldnt be very nice as he was obliging by giving her a lift. I will leave it up to herself although even if she doesnt, his no claims bonus is goosed anyway.

You don't have to look for millions. Look for her medical costs. Doctor visits and any after care. She is not claiming off the driver but the drivers insurance. Accidents happen and you are entitled to insurance, which is why we pay it. You are not entitled to take the Mick and claim falsely.
