Where do I stand with faulty used gearbox?

    As in the title, I purchased a used auto gearbox from a breakers to replace my existing one that was broken. After the gearbox was installed in the car, my mechanic found that I have been sold another dud, which is nearly worse than the old one that he took out.

    I purchased the used gearbox on the premise that it was fully functioning and the business would stand over it if it was found to be faulty. After a bit of messing around, the breakers are sending a replacement unit up to me, but I will still be significantly out of pocket for the labour intensive job to be done all over again in swapping it in. They are also requesting that I return the faulty unit they sold back to them when the replacement is delivered (which I think is a ridiculous expectation).

    Would it be reasonable in this situation to expect the breakers to pay the labour costs for the replacement box, seeing as it is their fault that the gearbox they sold me is faulty?

    They are replacing it, which is as much as they are obliged. Of course you must return the other one.

    you bought a second hand part, that is the chance you take!

    it would not be expected of any breakers to cover any labour costs in my opinion, as i said you bought a second hand box, not a reconditioned one!

    I presume your mechanic is up to speed and changed the filter and used auto transmission oil not bog standard gear oil?

    Yes, he used the correct specified oil and is a fully trained Volvo mechanic.
    it would not be expected of any breakers to cover any labour costs in my opinion, as i said you bought a second hand box, not a reconditioned one!

    Should the onus not be on them to make sure such major mechanical parts they sell are of a working standard though?

    yes, and they are replacing it. I don't think they would be liable for any more

    how are they to check a gearbox if car comes in crashed?
    You would have a comeback on a new one or a reconditioned one but with breakers you need to say a few prayers first and hope its a good one, thats the risk you take buying out of a crashed car

    It's a risk many people have to take and likely do. I wouldn't say anyone spends 3-4k on a brand new box for a 14 year old car.

    Yea i know that, i would have done exact same thing as you, breakers have no obligation though

    With second hand parts like gear boxes, engines, etc you really are taking a chance as you have no idea what condition they are in prior to fitting them. Going for a reconditioned box while initially more expensive will probably work out cheaper than having to pay to have a second hand one fitted twice. Lets hope the second one they are sending isn't fecked too.

    If the beakers had agreed to pay for fitting then you would be correct, but all they did was supply a part and they are replacing the part. That's gamble you take when buying parts from breakers, even the replacement could be bad and the OP would have to pay to get that removed. Sometimes it's cheaper to let the garage supply the part, as they would have to replace it if it was faulty

    Really disappointed at the way things have turned out and reckon I have been unlucky.

    Present thinking is offloading the car as spares/repair on donedeal and buying another banger. Will have lost money, but may just write it off as I'm fighting a losing battle.
