Employment law issue

    Having trouble at the moment and could do with a point in the right direction please.

    I commenced employment a certain amount of time ago (job offer and conditions by email) and I accepted the role in good faith. Quite soon after I started, I found the employer to be obstructive and non communicative and within two weeks he flagged to me that he thought my position may be untenable (there was a commission based element to the role) Seeing as it was on a part time basis, this statement was made within less of a full weeks work. I had already put a lot into the role in terms of commitment, both financially and professionally. He failed to deliver on promises (company phone etc and consequently the use of parking app etc). Anyway, he pipped me to the post and we have severed our association.

    He sent me an email (after non returned phone calls etc) to acknowledge that he owes me a certain amount of money, to send invoice for same and he would transfer money immediately. Needless to say this hasn't been forthcoming and given the lack of class this person has exhibited to date, I don't expect to see it.

    So my questions. As the claim is for under 2k can this be pursued through the small claims court? Secondly, the individual has two companies registered in his name, either one of which could be the company in question. How do I go about finding out which one it is given that both company names are generic and applicable to the nature of the business in question? Finally, my brother is a barrister and is horrified at the ill treatment. Should I ask him to write a letter before pursuing this through small claims? What would be the most effective next steps?

    Small claims court doesn't handle employment issues.

    Doesn't read like you were ever employed more self employed by the sounds of it, did you ever get a salary, pay tax. How long did this agreement last.

    A couple of days a week for four weeks. No money has changed hands although he has conceded in writing it is what I am owed and a date was agreed upon for bank transfer but this has not happened.

    I'd text or call him asking has he completed the agreed transfer every two or 3 days. He'll soon get sick of it and pay up. Or else just walk away with a valuable lesson learned about who and what terms your start work with anyone on. Ask all the right questions on day one of the job and you won't have this problem again.
