Insurance Fraud - Judge Orders Garda Investigation

    The defence claimed the car involved had, on inspection, shown signs of not having been used for some time and had been incapable of being driven as the clutch had not been operating and there was no power drive to the wheels when it allegedly hit the bridge.
    Zurich claimed that while there was evidence of damage as a result of a collision with the bridge, a damaged towing hook had been found attached to the car consistent with it having been towed to the area and “towed into the bridge.”

    Good work Zurich !

    Looks like case against MIBI.

    Zurich would have being handling on behalf of the MIBI. The claim would have been by the passengers against the uninsured 'driver' of the car. This is how families claim without the need for another vehicle to be involved

    There have been cases heard of car's placed in the holes dug during Public Works, then called in and claimed they were not sign posted, lit up etc. A deal of the problem is there is no onus or effort to investigate these claims, and the pay outs make it an ideal business opportunity if you have a brass enough neck.

    Luckily enough, soft tissue damage to a brass neck is nigh on impossible.

    Right, so a car is down a hole, no witnesses. The ambulance, Gardaí and recovery vehicle all visit the scene. Lots of ouch from the occupants of the car, who had just climbed in. How would you go about investigating? Lack of skid marks, just means the vehicle went in without braking

    I'm thinking that claiming money off these would-be fraudsters in a civil action will be throwing good money after bad (no assets) and if they're charged with a criminal offence, they'll get legal aid so our money will be spent to allow them to come up with an ingenuous/creative defence and they'll get off. In this case I'd say it would be very difficult to prove a crime to the level ('beyond reasonable doubt') required in a criminal prosecution.

    Check for bruising from seat belts if no bruising and they claim they where not wearing seat belts then they should have trauma that an x-ray or MRI will pick up

    I was referring to the case Ironclaw cited not the one in the OP. Not everyone who stages claims are as intellectually challenged as that lot. Most use working cars

    So somebody who advises an insurer for the 1st time that they intend to claim 2 years after the accident (as is their right at law) will have these marks?. What they will have is a consultant's report to prove soft tissue damage.

    I'm just saying, they whole thing is flucked and exploited on a daily basis

    Last time I checked Motor Insurance wasn't optional! so in a functioning society the driver should be getting struck hard with the baton of law for that alone!

    I would love to get voted in as Minister of Justice for three years with a good budget. Heads would roll...

    I wonder is this the same fella, the address matches.
    Patrick Oliver Ward, 37, of Hillcrest Avenue, Leigh, Greater Manchester, pleaded guilty to driving while disqualified and driving without insurance on Rufford Road in Ollerton on November 9. The offences breached a suspended sentence order. 24 weeks in prison.

    Unfortunately fraud cases are rarely as clear cut as this one.

    I know we can have a joke about the surnames and all that but if it were just a particular demographic that were up to no good then it would be easy to work against however its the genuine accidents where people exaggerate their injuries that are more of an issue.
