Clamping Question

    Was parked in Dublin City Centre and I didn't really I had strayed out of the parking zone I normally park in on a Sunday to one that had paid parking.
    Came back to the car and found it was clamped. I had parked on the right hand side of the road and walked up by it on the right hand side. Had I not had a passenger with me who actually noticed the clamp on the passenger side wheel. There was no notice on the car atall and only afterwards found the print out docket under the car.
    As you can imagine I was livid, as had i attempted to drive off I would have done some serious damage.

    Here's the weird part, The clamp wasn't actually secured on the wheel. And when i went to look at how the clamp was secured I realised the chain was only hung over the wheel and could be removed by hand. I took the clamp with me and It's fully intact, Just wondering can they take any action against me?

    Who issued the notice? Dublin City Council? If not, and it's a private company, just bin the notice.

    There's a thread very similar to this posted recently, can't remember which forum though. Exact same story open clamp with no notice, but they had a friendly person offer to remove it for a lot less than the clamp release fee. Call the council as if it's officially clamped they will still get you and if not I think that they may appreciate their clamp back.

    If it wasn't secured, and you got a random friend to return it, totally undamaged after you get a summons or fine in the post, you could completely reasonably claim you never saw it on your car. At the very least it would force them to do some work for their money.

    If DCC they will come after you for the fine. If its a private company, just ignore it.

    But DCC dont play around with anything. They hounded with not handing back a book from one of their libraries a few years ago. I imagine they would do the same with this parking fine
