Notice period issue

    Hi, posting this for someone else without a boards account.

    They have decided to leave their current job having received an offer for another. Their employer is requesting a notice period longer than required. The contract does not specify a notice period specifically but refers to the Minimum Notice and Terms of Employment Act 1973. Based on this, their notice would be 1 week but the employer has asked for 4 weeks. They don't wish to give 4 weeks notice. Where do they stand on this?

    If they haven't got a specific notice written into their contract, they only have to do the legally required amount.

    If they need a reference from the place, they may want to negotiate

    4 weeks is very extreme.

    They should offer to work two weeks and see how it goes.

    If the employer is being unrealistic they can simply walk away. 2 weeks is plenty in most cases.
