Claiming on (axa) insurance after rear-end

    A friend of mine rear-ended someone earlier this week. Was driving a Mercedes c200 and comprehensively insured through Axa.


    What is the policy as regards hire car in that situation? Is he entitled to a hire car and if so, for how long?

    Axa are saying that it's only possible if repairs are done through one of their centres. They're also saying they can only provide a sardine can (Ka or Auris) as a replacement. Is this correct - or do they need to replace like with like?

    Is there any obligation on the insurance company to pay out in lieu of car hire instead?



    The vehicle was towed to their approved centre. They are to do an initial assessment. However, the guy suggested that there could be a case of contributory negligence. When challenged on that, he said he was basing that on thread depth (of tyres). We went and measured them with him - and ONE tyre was equal to the legal minimum. I take it there's no case to answer here?


    Should we be looking to get this repaired at an approved centre OR to get this done independently with a cash settlement? They have not assessed yet but the guestimate provided so far is a €10K repair.

    Is that even possible?



    Any thoughts gratefully received.

    My previous motor was a SLK and insured with Axa. I rear ended someone. Car went to their approved garage in Kells. €8k+ damage to mine.
    I was given a 1lt pug 208. They won't be giving your mate like for like.
    Also, your mate is only entitled to the loan car for 7 days. If repairs take longer, he has to hire a car or pay the garage for extension of loan car out of his own pocket.

    In fairness, the repair work undertaken was 100% and my own mechanic couldn't even spot the repair/prior damage. Went on to part ex it at the start of this year and none of the dealers that were interested in the motor spotted it either.
