    Hi guys.

    Just wanting to check something for a mate. He was involved in a car accident and didn't hang around for the Gardaí. They eventually got him and told him they'd probably give him a caution. No one ever got back to him so he's wondering if the matters resolved (it's a few months now at this stage). If you get a caution from the Gardaí do you get a receipt or some confirmation that you've actually been cautioned?

    He probably got away with it at this stage. As for a caution, normally the Garda Super will issue it at the station...sort of like a statement.

    Don't think road traffic stuff comes under the adult caution stuff. It's more likely the other driver didn't make a statement.

    If (1) nobody was injured and (2) he exchanged all the usual details with the other party at the scene then there is no obligation to either report the accident to the Gardai or even to 'hang around' and wait for them.

    That said, if you're involved in a fender bender and the other guy gets up on his high horse and refuses to exchange details with you until the Gardai arrive (if they ever do), you're in unknown territory. Technically you could write your details on a piece of paper, put it under one of his wipers and drive off and you would have complied with your responsibilities under S.106 of the RTA.
