NBP consultation: eir rattles sabre on State Aid Rules

    The submissions to the July Reports/Consultation have been published and eir are clear on a few things.

    First on the use of ESB's pole and duct network....
    For the avoidance of doubt use of the ESB infrastructure by one bidder only and failure to make it available to all other bidders would be contrary to the SAG and State Aid rules. The ESB is owned by the state and its actions and assets are imputable to the State. A failure to deal with this point prior to the tender will only delay the implementation of the NBP.

    Second on whether its June announcement (the blue lines) should be taken seriously...
    A significant factor is that the current policy proposal is predicated on an intervention footprint that covers 768,000 premises whereas eir has already announced its intention of delivering service to an extra 300,000 premises within the currently defined intervention area. The DCENR is currently assessing this extra investment proposal along with similar proposals from other operators and we expect that as result of this exercise the intervention area will contract in size. For the avoidance of doubt, eir will deliver this extra investment in any event.

    Academic I guess since ESB Networks have a lot of leeway in what they charge for pole access / set SLA's for provision / repair that would get by the regulator. For health and safety reasons they'd have to get their guys to do the work or at least joint visit , at their rates. Just like Eir does when allowing others to use their poles.


    Like anything else the devil is in the detail.

    Not sure if this is the Irish Times recycling old news but....
    Eir says it expects the National Broadband Plan to be altered to accommodate the roll-out of its new fibre network, which will supply more homes than the company previously envisaged.

    Eir is willing to sign a binding commitment to deliver high-speed fibre broadband to 300,000 homes and businesses at the centre of a year-long tug-of-war between it and the government.
    Speaking to the Irish Examiner, Eir chief executive Richard Moat said the company was now willing to sign such an agreement.
    The fact that it has begun the rollout and will have covered 100,000 of the 300,000 premises by the end of the year should reassure the government of its ability to deliver on its promise, he added.
