Planning permission question

    Hi guys,

    Kinda stuck here and need advice.. i have a site to build on a family site where there is also my grannys house, but on her conditions for her planning at the time 19 years ago it says it should not be subdivided or sold for more construction.
    Anyone any ideas if i will get over this ?

    Through a planning application is how you deal with this condition, i.e. application for a house on the site. As I said on the other thread, seek a pre-planning meeting with the Council to get their opinion on it before you spend any money.

    what is the 'exact' wording of that condition?

    is it a section 47 agreement condition?
    if so, is there any reference to immediate family members being exempt from this sterilization ?

    It says condition 9. The site shall not be sub-divided and no part of it shall be sold off separately from the overall site containing 1.4 acres. And the reason is : in the interest of orderly development in the area.

    This was in 1995, and other houses were built in the community since.

    ok then, no section 47.

    the only way this can be altered is by a new planning condition, to remove that condition, to reduce existing site boundaries of planning file 95/XXX and for new dwelling etc etc

    definitely worth a pre planning meeting to discuss this before doing any work, as its by no means a simple application

    A sterilisation clause is what it's called and has not been applied for a number of years so I would guess that for a family member they would be prepared to over-rule it.
