Return rights - Paypal Disputes

    Hi folks,

    I ordered 3 items from an online retailer, paid via Paypal and after 8 days received two of the items with one missing.

    After contacting the retailer - he informs me that the third item was unavailable but he can get it from China and it will take "2 weeks".

    So - he should have told me that the item was unavailable before dispatching - I never would have placed the order on this website had I known it would take 2 weeks to get this item (as I could have ordered it myself from China). For me, the order only made sense as a whole.

    So what is my position? Because of the principal of the thing - he chanced his arm and just dispatched what was available without informing me - I would like to send the two items back and receive a full refund including the original shipping charge and the return shipping charge. Also - I am fully aware that the third item may never arrive from China at which point I will have run out of options with Paypal.

    What am I entitled to and what would the likely outcome be if I initiate a Paypal dispute if the seller refuses to the above resolution?
