Have I a right to cancel my order?

    Hey guys. Ordered a Seat Leon FR from the dealership here at home. At time of ordering it was supposed to be delivered in 8-10 weeks which would have put it end of September. Still not here and every time I ring the dealership they seem to have a different story. Apparently at the moment it's in Dublin and they're waiting for it to get on the truck down. This initially was supposed to happen last week but 'human error' meant they didn't load it etc. Just wondering would I be within my rights to cancel it seeing at this stage it'll be nearly 161 by the time it arrives?

    Let it be a 161,

    if your trade in is a big part of the deal ,just give them your trade in now and ask for a cheap,loaner replacement and collect the new one in January , 9 weeks away , a assuming they're not going to go insolvent in the meantime. I recommended this to a lad a few years ago and all worked out well.

    Last boat in was the 15th October and I've had a good few Audi/VW/Skoda's that were on the boat - come and gone already. Most down to Cork for PDi and back up to Dublin.

    Suppose it's possible that the transport company forgot to load it, but sounds a bit far fetched.

    Push it out to Jan for delivery - not much point cancelling at this stage after waiting so long, but not worth registering now.

    Don't take a sob story from the dealer that he needs the reg for targets either - unless he'll knock another €3k off!

    Seems like a great idea. Give the garage his good car so they can get the maximum value from it asap and let the OP drive around in a heap until the garage can get their act together and deliver his car.

    Do you have your com number? Ring the dealer and ask for it. Then call VW Ireland and find out where exactly it is.

    Personally at this stage I'd wait for the new year.

    It's the difference in him getting a 152 a couple of weeks from the end of the year or a 161 in the first few days of January. I know which I'd go for.

    OP that sounds like complete boll*x claiming it wasn't loaded. Your after buying a new car, if that was the case they'd fire someone from the dealership onto a train and have it collected the same day it was "forgotten"

    Absolutely agree. I just don't think it was reasonable to suggest that the OP hand in his trade in early to suit the dealer when they aren't sticking to the deadline they promised.

    I'd suggest they keep it until 161 or tell them you are no longer interested.

    Absolutely agree. I just don't think it was reasonable to suggest that the OP hand in his trade in early to suit the dealer when they aren't sticking to the deadline they promised.

    I'd suggest they keep it until 161 or tell them you are no longer interested.

    The problem with that is that he may have to take a further hit on the trade-in price of his old car. The dealer may sell his old now for more than next Jan when it's deemed a year older.

    but why would the customer take a hit when a price has been agreed, a deposit paid, a date has been arranged and the dealer can't fulfill. is it really the customers place to take the hit?

    i mean, i understand why they would like his trade in early, i just don't think it's fair.

    But if the customer wants to register the car in 2016 now instead of 2015 then that changes things too. The agreed trade-in price could have been based on the 2015 value of the old car. Having a trade-in muddies the water.

    Also I'd have a look at the small print of the terms of agreement, very few dealers, distributors/manufacturers will commit to a specific delivery date as there are too many variables involved that could change that date.

    yeah, well i'm sure the dealer will try to have him by the balls to take it in 2015 for targets, trade in prices etc, but realistically if a deal was made and they don't fulfill their end i wouldn't be playing into their hands if it didn't suit me unless they incentivised it somehow. you can be sure if the shoe was on the other foot and the car was on the forecourt, they wouldn't take a breath trying to get him in to close the deal. there's just nothing worse than BS and if they told me they forgot to put my car on the lorry to try and fob me off, well, :rolleyes: you get a good indication of the level of customer service you are dealing with.

    To be fair to whichever dealer it is, they are not the ones loading the trucks.

    It's not totally unheard of for cars to "missed" from the transport truck (or delivered to the wrong place and have to go back).

    There is always the option of collecting from the compound, but it depends on where the dealer is. If they are close to Baldonnel then there's no excuse, but it they are in West Cork they may not want to add 250km to a brand new car before delivery, and have no other option but to wait on the next truck.

    Still sounds a bit far fetched to me and it may only be arriving on the boat coming in today.

He then gave me the option of them hanging on to it for a 161 but I'll probably have to pay a bit more because my own car will be worth less and it'll be a 161 price etc etc. Don't know whether to take it Saturday or pay maybe up to €2000 for a 161. I thought buying a car was supposed to be enjoyable!

    One or two extras but nothing special- sunroof mainly. And ya I've a bit of a deposit paid. I'm thinking I'll just collect it Saturday

    Go in there and make it clear that due to their error the car was delayed and you expected it earlier and you were assured you would get it. They're not going to want you to walk. In the meantime price up ordering now for the new year with another dealer or two to be sure what they are asking extra isn't over the odds, adjusting for the deposit if its not returned obviously.

    I had something very similar two years ago and was given a loan car to allow them sell my one. This time of the year is slower for used cars and unless your current car is ultra rare or desirable it may not sell before 2016.

    Id tell the dealer you just want to leave it till january but your not paying the difference for the mistake, its november next week so 8 weeks away. even if they want to take your car now in exchange for you not paying, you could get something for 700 that would last 8 weeks and sell for pretty much that. well worth it Id say.

    Jumping on thread here... sort of in same boat. Booked a new car, paid deposit to be delivered/registered Nov 2nd. I have special reason for needing decent car following week. But 'booked' car got sold to someone else! and another one is sourced to dealer in midlands.... then it 'missed' a ride on transporter back to Dublin. Now dealer is offering to fetch it himself and drive it back up.

    Looking at 't's & c's' , I dont think I have much option in getting my deposit back.

    At this stage I have lost faith in the dealer. Anyway is it a good idea to drive a new car immediately on motorway? Dont tyres need a gentle ride initially?

    Did you collect the car? If the car was originally scheduled for the end of Sept and instead landed end of October it's just one month out, not ideal but not something to be stressing too much over either. I ordered a car earlier this year, was told 10 to 12 weeks. It took 22 in the end! I would ask the dealer for something your way for the inconvenience of the delay, free service pack or something maybe? How long do you plan on keeping the car? 2k sounds a lot for a waiting to 161. I doubt your trade in will depreciate anywhere near 2k. And the seat is already paid for by the dealer so it's price shouldn't change I would have thought.

    This is for €750, reduced from €950. Pay €600, tax for €420 for 3 months and sell it in January with a months tax and 9 months NCT. Nice waiting room for your new SEAT.
