A little Help On Entitlements

    Hi All,

    I've never been well up on entitlements.

    My cousin wants to rent out the home farm and he wants the entitlements also.

    I know I can lease the farm with entitlements for 10 years with a portion of it tax free but am wondering will I get my entitlements back at the end?


    Has anyone got any link or info in relation to leasing out entitlements?

    I'm still waiting for Teagasc to call back

    In a word legally no
    You are only supposed to draw entitlements if you are a farmer/farming the land
    Nobody has crystal ball to what will happen post 2019


    On a side note this grinds my gears people drawing entitlements and thinking they are a reward for owning land

    Hi Epff,

    The land is currently being farmed at the moment, I'm paying my cousin to farm it for me, I have him assigned as farm manager. Its not idle, overstocked if anything.

    I'm away enjoying life for a few years but will be back to farm in probably 5 or 6 years.

    Your crystal ball point is what I thought, but just said I'd throw it out there.

    I'm not sure if this information is correct best to ask your local solicitor.
    I think trading entitlements was stopped this year as its a reference year.
    I would think selling is selling and leasing is leasing and you should get them back if done through solicitor.
    Personality I preferred to see entitlements attached to land rather than when it used to be tied to production and the factory was the only one gaining from beef and slaughter premiums.

    Ok, I've had a call back from the teagasc adviser, who didn't seem 100% certain when quizzed.


    His take on it is like you said, none allowed this year as it was a reference year.
    He said you can sell and lease as per normal for next year starting Jan 2016.

    My big worry is when I come home (prob 2010) and start farming I'd have them back.
    he was saying you can lease them out but if you go past 2019 when CAP is re negotiated you might loose them.

    Rock and a hard place.

    Surely there is a way around it.
    Farm partnership etc.
    Set up joint bank account have department payments paid to that and your drawings from it could be equal to agreed rent for the year.
    You would be more a silent partner over seeing management from a distance.
    Have agreed time to withdraw your payment and for a set term.
    Where there's a will there is a way.
    Partnership contract rearing etc.
    Advisor should know about leasing in January or advice on partnership etc.
    If he can't get another advisor.
