Entitlements and Herd number

    Can somebody please tell me does the herd number and entitlements form part of the residue if not specified in the will? No mention of them by the solicitor at any stage in administering the estate.

    The herd number strictly does not it just a herd identifier used/issued by the Department to identify a herd. (In practise the Dept will continue to use the herd number as long as the herd exists and payments outstanding to it. If you inherit the herd etc the Dept will register you as the new owner of that hard and continue to use the number.) The entitlements and herd (cattle) fall into the residue and go to the residuary beneficaries. Probs arise where land and the residue get separated; anything not disposed of by specific bequest falls into the residue.

    Are you sure that the Dept will continue to use the original herd number as long as the herd exists and pay any outstanding payments. Only reason that I ask is when my Uncle died 9 years ago the beneficiaries (my brother and I) had to go into the local DVO and one of us (me) had to become the "herd keeper" of that herd number. We were allowed to sell stock but until Probate was completed my Uncles SFP/DAS payments were withheld.
    As "Herd Keeper" I was issued a new herd number about a year and a half later.

    There always has to be a herd keeper so until the herd gets sorts the herd owner, when someone dies the legal reps, appoint one if the herd not getting sold. Until probate granted all entitlements etc go to the legal reps who hold it in trust for the beneficaries. Probate and all this very slow should use CCS/AE Notification of Bank Details for the Administration of Estates Form; send that to Cavan and you get your payments, You are right Base Dept not issue payments until probate granted unless its a hardship case. You will get the hardship case form off the Inheritance unit in Portlaoise. . As 2 people inheriting was I guess simpler for DVO to issue a new herd number.

    The stock was sold as part of the residue. I will have to follow up now with executor regarding the entitlements.
