Does the Bank have to sign and seal a mortgage agreement?

    What would be the position if only the borrowers signature was present on the mortgage agreement. is the agreement still valid?

    It's a good practice, obviously, for both parties to execute all copies of the mortgage document. But as long as the bank (a) has advanced the money, and (b) has documentation executed by the borrower, the bank can enforce the terms of the documentation against the borrower. It's the borrower who wants a copy of the documentation executed by the bank.
