Do you have to mention a conviction from over 5 years ago?

    5 years ago I was put off the road for drink driving. I appealed it and got it back after 18 months.

    I rang up NDLS and they said that endorsements no longer remain on your licence.

    Do I still have to mention it to Insurance companies? What are companies policies like these days, do they ask for convictions in the past 2/5 years? Or do they ask in your life?

    Any advice appreciated.

    Some will ask about convictions in the last 5 years. Some will just ask the open ended question about convictions at any time.

    As there is no spent conviction legislation here, you have to answer what they ask.

    Would spent conviction legislation change the answer when the question is from an insurance company?

    Any kind of conviction counts for some strange reason,a mate of mine was charged and pleaded guilty to drunk and disorderly drunk in a public place about 10yrs ago
    About 2yrs ago he rang fbd for a quote and they refused him based on this.
    At the time of getting refused he had a full clean license and 5yrs no claims.
    Then again it varies from person to person
    My brother is younger less driving experience both late 20s full clean licences max no claims and still he has gotten lower quotes sometimes on renewals

    Yes, unless the crime was insurance fraud I think.

    But if the question is "have you ever been convicted of a road traffic offence?" then surely the answer would be yes, even if there is spent conviction legislation in place.

    No, the spent conviction bill says if certain conditions are met:

    Where, otherwise than before a court, a question is put to purporting to seek information in relation to the person’s previous convictions or the circumstances ancillary thereto and the person has a conviction which is, in accordance with this Act, regarded as a spent conviction, then, subject to the provisions of this Act—

    (a) the question shall be regarded as not applying to the spent
    conviction and the person may respond accordingly, and

    (b) the person shall not incur any liability or be otherwise
    prejudiced in law because he or she did not disclose the
    spent conviction or the circumstances ancillary to that
    conviction.
