    Hi Bridget, I think there seems to be a misconception regarding sick notes. A sick note is issued to confirm that you are fit and able to return to work.

    As soon as you become sick, you should notify your employer prior to your normal commencement of work time. You should give a general nature of the illness and expected duration.

    A sick Cert, not a note is required after 3 days by your doctor and weekly thereafter. The employer is not entitled to know explicit details of what ails you, just that you are unable to attend work due to health reasons.

    Employees are adults. If an employer has any question with regard to the health of their staff, they can at their expense send you to their company doctor for assessment - which your are required to attend.

    So in short, a sick note from your own doctor is not required on first day of illness, if an employer requires a sick note, it must be at their expense via company doctor.

    Sorry Jayo but if you're going to claim something like don't need sick notes from day 1 at least check the source you're using:
    You can decide how soon you require a medical certificate from an employee.
    Hence the answer is it depends on the company policy; if the policy requires it from day 1 then it's from day 1.

    If she is working for the employer longer than 2 months and no Terms of Employment regarding sick leave has been issued to her, then none exists. (See Section 3 of Terms and Conditions of Work Act 1994 http://www.irishstatutebook.ie/eli/1994/act/5/section/3/enacted/en/html)

    Specific terms & conditions cannot be entered into an employees contract without employees consent. Basically an employer cannot make up the rules as they go on. So without it being specified in contract, the normal rule is after 3 days, phone call first day followed up with certs and or phone calls thereafter. If an employer requires doctors notes on first day without it being part of the T&C of employment, the employee should attend the company doctor at employers expense.

    If an employee is regularly missing days, there is or at least should be a disciplinary procedure in place to address this. Having the employee attend the company doctor is one way of assessing the true health of an employee if there is any doubt over excessive absences.

    Or they could ask is it really needed because their policy requires it and they think it's a waste of money to get it; the simple answer is we don't have enough facts to make a call beyond saying read the company policy at this stage and get more information to make a call beyond that :).

    Maybe Bridget hasn't read her contract/terms & conditions properly :confused:

    In response to Bridget's question, I'd ask her what is defined in her work conditions? That will guide her if she needs a sick cert after one day or not.
