Frustration of contract

    Hi all,

    Im looking for some legal advise on a small residential service dispute. I signed up to an 18month contract with a home broadband service provider 10 months or so into the contract I wish to cancel as the rent on the property where I was living in rose beyond my budget and I cannot find suitable accommodation at the moment the service provider wishes to charge a termination fee of 190euro or so to which I am objecting since the matter was beyond my control would I be within my rights to plead frustration of contract and have the fee waived?

    You won't get legal advice here, it's against the charter.

    It's not the service provider's fault you have to move so they are not obliged to waive the fee unless that's stated in the contract.
    You can certainly appeal to the service provider's good nature but don't expect success.
    See if you can move to another property serviced by the bb provider and ask to have your account transferred to there.
